The role of the Legal Advisor is to provide practical legalsolutions and support to ensure compliance with the business's variouscontracts as well as with relevant laws and regulations, protect the Company'sassets and maintain the Company's reputation.
- To advise management and other staff on the underpinning legislationwithin the Property Industry and other law affecting the Company;
- Scrutinizing agreements submitted for signature and thereafterfacilitating signature;
- Tracking of Lease Agreements - this will include making entries on therelevant schedules, following up with the relevant parties and updating scheduleson a weekly basis;
- Payment management - this will include checking the correctness ofinvoices, procuring authorisation, instructing the finance department, sendingproof of payment to the relevant payee and ensuring that all invoices areentered on the relevant tracking system;
- Work with other departments when required to assist them on implementingsystems to ensure the effective and timely operation of the Company'sresponsibilities under the various bodies of law which affect the Company;
- Assisting the Head of Legal in litigious matters, including but notlimited to obtaining information from key role players, collating and preparingdocuments, photocopying and scanning thereof;
- Primary contact with external attorneys / counsel for landlord / tenantlitigation matters. This includes, but is not limited to, issuinginstructions to external counsel, answeringall nonstrategic questions passed by external attorneys / counsel, supplyingexternal attorneys / counsel with all necessary documentation and support onlitigation matters; conducting investigation /review of background, availabledocumentation, charges levied, pleadings, motions drafted by external attorneys/ counsel, reviewing of all settlement agreements, reviewing and responding toall correspondence;
- Managing external attorneys (including following up; ensuring reportsare received timeously);
- Training of internal personnel on the legal implications of legislationand standard documentation.
- Assist the Head of Legal with research, investigating and initiatingdisciplinary hearings within the company;
- Assisting with implementation of leasing relationships from a legalperspective (from commencement to expiry);
- Negotiating suitable settlement agreements with tenants on various areasof dispute;
- Drafting legal reports as required
- Assisting with ad hoc daily advice to the various departments within thebusiness
- Setting up a database of templates and ensuring contracts register areupdated and maintained;
- Setting up and attending various meetings with contractors, suppliersetc.
- Advise, negotiate and prepare agreements relating to the leasing ofproperty within the commercial property sector;
- Drafting and compiling of standard policies and procedure documents thatrelate to the Business;
- Advise, negotiate and prepare agreements and documents relating to HRmatters; and
- To undertake other such duties as maybe reasonably requested by the Headof Legal.
- Atleast 3 years' experience in the Property Industry
- An L.LB. degree from an accredited educational institution
- Admission as an Attorney;
- Practical experience within the Landlord/Tenantsector
- Experience in drafting of legal agreements (especially lease agreements),documents, opinions and conducting of legal research;
- Ability to interpret and apply / enforce agreements;
