STANDARD TERMS AND CONDITIONS OF SALE

These Standard Terms and Conditions of Sale ("Terms") govern all purchases of assessments and related services (“Products”) from Assessify ("we," "our," or "us"). By placing an order with us, you agree to be bound by these Terms.
1. DEFINITIONS
1.1 "Customer" means the person or entity purchasing Products from Assessify.
1.2 "Products" include assessments, AI-generated reports, and any other services offered by Assessify.
2. ORDERS AND ACCEPTANCE
2.1 All orders are subject to acceptance by Assessify.
2.2 Orders are confirmed only upon receipt of full payment.
3. PRICING AND PAYMENT
3.1 All prices are listed in Rands (R) and are subject to change without notice.
3.2 Payment must be made at the time of purchase using accepted payment methods.
3.3 Assessify reserves the right to cancel orders for non-payment or payment disputes.
4. DELIVERY OF ASSESSMENTS
4.1 Assessments are delivered electronically via email to the specified participants.
4.2 The Customer is responsible for providing accurate email addresses for delivery.
4.3 Assessify is not liable for delays or failed delivery due to incorrect information provided by the Customer.
5. CANCELLATION AND REFUNDS
5.1 All sales are final. Refunds are not provided unless required by applicable law.
5.2 If a technical issue prevents the delivery of Products, Assessify will work to resolve the issue or provide a replacement.
6. USE OF PRODUCTS
6.1 Products are for the Customer’s internal use only and may not be shared, resold, or distributed without written consent from Assessify.
6.2 Customers and participants must comply with all applicable laws when using Products.
7. LIMITATION OF LIABILITY
7.1 Assessify is not liable for indirect, incidental, or consequential damages arising from the use of Products.
7.2 Our maximum liability is limited to the amount paid for the specific Product.
8. INTELLECTUAL PROPERTY
8.1 All intellectual property rights in the Products, including assessments and AI-generated reports, are owned by Assessify.
8.2 The Customer is granted a limited, non-transferable license to use the Products for their intended purpose.
9. CONFIDENTIALITY AND DATA PROTECTION
9.1 Assessify processes personal data in accordance with our Privacy Policy.
9.2 Customers must ensure that they have the appropriate consent to provide participant information to Assessify.
10. FORCE MAJEURE
10.1 Assessify is not liable for failure or delay in performance due to causes beyond our reasonable control, including natural disasters, technical failures, or government actions.
11. AMENDMENTS
11.1 Assessify reserves the right to amend these Terms at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of the updated Terms.
12. GOVERNING LAW AND DISPUTE RESOLUTION
